Looks like some homeowners are not paying attention to easements and covenants on their property.
In a recent Vancouver Sun article Ian Mulgrew writes of a Supreme Court decision involving neighbours, a fence and some poor conduct. While I have not read the decision, the article references a restrictive covenant identifying a privacy fence, an easement and an encroachment.
I can only assume that the owners were not aware of these charges. If they were, some of the conduct may have been avoided.
